Please read these Terms & Conditions carefully before using our services. Your use of the Site and services constitutes your agreement to be bound by them.

1. Acceptance of terms

By accessing or using the DigitalGrowth website (the "Site") or any service we provide, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Site or our services.

2. Services

DigitalGrowth provides digital marketing services including but not limited to SEO, paid advertising, web design and development, lead generation, branding, social media management, and analytics. The scope and deliverables of any engagement will be defined in a written Statement of Work (SOW) between you and DigitalGrowth.

3. Payment terms

Unless otherwise agreed in a SOW, invoices are due within 14 days of issue. Late payments may incur a 1.5% monthly interest charge. Services may be paused for accounts more than 30 days overdue.

4. Intellectual property

You retain ownership of all content, data, and brand materials you provide to us. Upon full payment, you own the final deliverables produced under your SOW. DigitalGrowth retains the right to use case studies, anonymized data, and portfolio examples for marketing purposes unless explicitly excluded in writing.

5. Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement. Confidentiality obligations survive the end of the engagement for 3 years.

6. Limitation of liability

To the maximum extent permitted by law, DigitalGrowth's total liability arising out of or related to the Site or our services shall not exceed the fees paid by you in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

7. Termination

Either party may terminate an ongoing engagement with 30 days' written notice after the initial 90-day term. Fees for work completed up to the termination date remain payable.

8. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.

9. Changes to these terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated "Last revised" date.
